THESE TERMS OF SERVICE CONTAIN AN ARBITRATION PROVISION AND CLASS ACTION WAIVER WHICH LIMIT YOUR RIGHT TO HAVE A DISPUTE HEARD IN COURT. PLEASE READ THESE TERMS CAREFULLY.
One to Another Vintage ("we," "us," or "our") is a reseller of pre-owned, vintage designer handbags. We sell through our website at https://www.onetoanothervintage.com and through Whatnot (collectively, the "Service" or our "sales channels"). These Terms of Service ("Terms") govern your access to and use of our sales channels and any purchases you make from us. By accessing or using our website, creating an account, making a purchase on our website or Whatnot, or attending one of our Whatnot livestreams, you agree to be bound by these Terms. If you do not agree, please do not use our Service.
Please note that purchases made through Whatnot are also subject to Whatnot's own terms of service and policies. In the event of a conflict between these Terms and Whatnot's policies, Whatnot's policies will control for transactions conducted on their platform.
Eligibility
You must be at least 18 years of age to use the Service or make a purchase. By using the Service, you represent that you have the legal capacity to enter into a binding contract. If you are using the Service on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.
Account Registration
To make a purchase on our website, you may be required to create an account. You agree to:
Provide accurate, current, and complete information at registration and keep it updated.
Maintain the confidentiality of your account credentials and notify us immediately at onetoanothervintage@gmail.com of any unauthorized use.
Accept responsibility for all activities occurring under your account.
You may not have more than one active account, and you may not sell, transfer, or assign your account to any third party. We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.
Products, Authenticity & Condition
All items sold through the Service are pre-owned, vintage designer handbags unless explicitly stated otherwise. We are not affiliated with, authorized by, or endorsed by any designer brand. Brand names referenced in our listings are used for descriptive identification purposes only. We take authenticity seriously and conduct a multi-step authentication review on every item we sell. However:
Items are sold in pre-owned, vintage condition. Signs of wear are normal and will be disclosed in each product listing.
Product descriptions, photographs, and condition notes are provided in good faith. Please review all listing details carefully before purchasing.
Designer brands are not involved in our authentication process and bear no responsibility for products purchased through the Service.
Items sold with a Certificate of Authenticity (COA) issued by a third-party authentication provider (such as Entrupy or similar accredited services) are eligible for our Authenticity Guarantee described in Section 7 below.
Pricing & Payment
All prices are listed in US Dollars (USD). We accept major credit cards and other payment methods displayed at checkout on our website. Whatnot purchases are processed through Whatnot's payment system in accordance with their policies.
By submitting payment, you authorize us (or the applicable platform's payment processor) to charge your payment method for the total amount shown, including applicable taxes and shipping fees. You represent that you are authorized to use the payment method provided. We reserve the right to correct pricing errors and cancel orders placed at incorrect prices, with a full refund issued to the customer.
Shipping Policy
Processing Time
All orders require 5-7 business days for processing before shipping. Orders are processed Monday through Friday, excluding holidays. Processing times may vary based on order volume and product availability.
Shipping Methods & Carriers
We ship from the United States via UPS or USPS for domestic orders and DHL for international orders. Domestic orders are shipped at discounted standard rates. International shipping costs are calculated at checkout. Once an order ships, you will receive tracking information via email. Delivery times vary by carrier and location, and we cannot guarantee exact delivery dates.
Insurance & Signature Confirmation
All orders valued over $100 are shipped with additional insurance and require a signature upon delivery. If you are unavailable to sign, you may need to coordinate pickup with the carrier.
Shipping Liability
Once your order leaves our facility, we are not responsible for:
Lost, stolen, or misdelivered packages.
Delivery delays caused by the carrier, weather, or other circumstances beyond our control.
Packages returned due to incorrect or incomplete addresses provided at checkout.
If you experience any of these issues, please contact us so we can help. Since we handle all shipping claims, customers must cooperate with us throughout the claims process. We will work directly with the carrier to file a claim, and any refund or replacement is contingent on the carrier's resolution. Failure to provide requested information may result in an inability to recover a refund.
Address Accuracy
You are responsible for ensuring your shipping address is correct at checkout. If an order is returned to us due to an incorrect or incomplete address, you are responsible for any additional shipping fees to resend the package.
International Shipping & Customs
International customers are responsible for all customs fees, duties, import taxes, and compliance with their local import laws. Delays due to customs processing are beyond our control. If an international package is refused or undeliverable, the customer is responsible for any return shipping costs.
All Sales Final: Refund & Return Policy
ALL SALES ARE FINAL.
Due to the high-demand, one-of-a-kind nature of our inventory, we do not accept returns, exchanges, or cancellations under any circumstances, except as expressly provided in our Authenticity Guarantee (Section 7) or as required by applicable law. Please review all photos, descriptions, and condition notes carefully before purchasing. We encourage you to contact us with any questions prior to checkout; we are happy to help you make a confident and informed decision.
One to Another Vintage Authenticity Guarantee
One to Another Vintage stands behind the authenticity of every certified item we sell. All items labeled and sold with a Certificate of Authenticity (COA) issued by a third-party authentication provider (such as Entrupy or similar accredited services) are covered under our money-back Authenticity Guarantee for one (1) year from the original date of purchase.
How to File a Claim
If you believe your certified item is not authentic, you may submit a claim within one (1) year of your purchase date by contacting us at onetoanothervintage@gmail.com. To initiate a claim, you must provide:
A written expert assessment from an independent, accredited luxury authentication service clearly stating that the item is inauthentic.
Supporting documentation including photographs, serial numbers, and condition details.
Proof that the item matches the original "fingerprint" (photos, serials, condition details) submitted at the time of our certification.
Our Review Process
Once your claim is submitted, we will:
Review your submitted evidence.
Request that you ship the item to us (we will provide a prepaid shipping label).
Inspect and assess the item to verify: (a) it is the original item sold (no alterations or replacements), and (b) its condition remains materially consistent with the certified state at time of sale.
Remedy
If our review confirms that the item is both the original item sold and is deemed inauthentic, we will, at your preference:
Refund 100% of your original purchase price (excluding tax and shipping) to your original payment method, or
Issue store credit at the same value.
If the item is found to be authentic, or if the external assessment is determined to be inconclusive or flawed, the item will be returned to you and no refund will be issued.
Limitations & Exclusions
This guarantee applies only to items sold with a COA.
Claims must be filed within 12 months of the original purchase date.
Items must remain in substantially the same condition as when sold. Damage, alterations, or significant wear beyond normal vintage use may void the guarantee.
This guarantee is non-transferable and may only be exercised by the original purchaser.
Final determination of eligibility rests with One to Another Vintage after internal review.
Cancellations
Because we process and ship orders quickly, we do not accept cancellations once a purchase is placed. Once an order is confirmed, it immediately enters our fulfillment workflow.
In rare cases, a cancellation may be granted at our sole discretion, primarily in the following situations:
Returning customers with a documented history of purchases.
First-time buyers on Whatnot, per Whatnot's cancellation policy.
Even in these situations, cancellation is not guaranteed. Requests will be reviewed on a case-by-case basis and must be submitted as soon as possible after purchase. On Whatnot, cancellation requests made after the livestream has ended will be automatically declined. For all other orders, once an item is in transit or in the final stages of fulfillment, cancellation is no longer an option.
Sales Tax
Purchases may be subject to sales, use, excise, or other taxes depending on your jurisdiction. The estimated tax shown at checkout may be updated when your order is finalized. If you claim tax exemption, you must provide appropriate documentation before we release the item.
User Conduct & Prohibited Uses
You agree not to:
Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
Scrape, copy, reproduce, or resell our content, product listings, or data without our prior written consent.
Attempt to gain unauthorized access to any part of our website or systems.
Submit false, fraudulent, misleading, or defamatory information or reviews.
Interfere with or disrupt the functioning of the Service or our infrastructure.
Use automated tools, bots, or scripts to access or extract data from the Service.
Impersonate any person or entity or misrepresent your affiliation.
User-Submitted Content
If you submit reviews, feedback, photos, or other content ("Postings") through our website or social media channels, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, publish, and display such Postings for any lawful purpose, including marketing.
We may use your feedback or review for promotional purposes, displaying your first name, last initial, and general location (e.g., "Jane D., Irvine, CA"). You may request removal of your content at any time by contacting us at onetoanothervintage@gmail.com.
You represent that any Postings you submit are accurate, are not defamatory or unlawful, and do not infringe any third-party rights. We reserve the right to remove any Posting at any time, with or without notice.
Intellectual Property
All content on the Service (including text, photographs, logos, and branding) is the property of One to Another Vintage or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes only. You may not reproduce, distribute, or use our content without our prior written consent.
DMCA: Copyright Infringement
We respect intellectual property rights. If you believe content on the Service infringes your copyright, please send a written notice to onetoanothervintage@gmail.com with the subject line "Copyright Notice" including:
Your electronic or physical signature and authorization to act on behalf of the copyright owner.
A description of the copyrighted work and its location on our website (including the URL).
Your name, address, phone number, and email address.
A good-faith statement that the disputed use is not authorized by the copyright owner.
A statement under penalty of perjury that the information is accurate.
We may remove infringing content and, where appropriate, terminate accounts of repeat infringers. Knowingly misrepresenting infringement may expose you to liability.
Third-Party Links & Services
The Service may contain links to third-party websites or use third-party payment processors, shipping carriers, and analytics tools. We are not responsible for the content, privacy practices, or security of any third-party sites or services. Your use of third-party services is subject to their own terms and privacy policies.
Electronic Communications
By creating an account and providing your email address and/or phone number, you expressly consent to receiving electronic communications from us, including order confirmations, shipping updates, account notices, and (where you have opted in) marketing messages. You may opt out of marketing communications at any time by clicking the unsubscribe link in any email or contacting us at onetoanothervintage@gmail.com. Opting out of marketing will not affect transactional messages related to your orders or account.
Force Majeure
We will not be liable for delays or failures in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, pandemics, acts of war or terrorism, labor disputes, government actions, or carrier disruptions. In such cases, we will notify you and offer to defer shipment or issue a refund where applicable under our policies.
Disclaimer of Warranties
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS. THE FOREGOING DOES NOT AFFECT ANY RIGHTS YOU MAY HAVE AS A CONSUMER UNDER APPLICABLE LAW.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ONE TO ANOTHER VINTAGE AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF THE SERVICE OR PURCHASE OF PRODUCTS. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) $500 USD, OR (B) THE AMOUNT YOU PAID FOR THE SPECIFIC ITEM IN DISPUTE IN THE TWELVE MONTHS PRECEDING THE CLAIM. THESE LIMITATIONS DO NOT APPLY TO LIABILITY ARISING FROM INTENTIONAL MISCONDUCT OR GROSS NEGLIGENCE, OR WHERE EXCLUSION IS NOT PERMITTED BY APPLICABLE LAW.
Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless One to Another Vintage and its owners, officers, employees, and agents from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of or access to the Service; (b) your breach of these Terms; (c) any content or Postings you submit; (d) your violation of any applicable law or third-party rights; or (e) any fraud, misrepresentation, or intentional misconduct by you.
Dispute Resolution & Mandatory Arbitration
Informal Resolution
In the event of a dispute, please contact us first at onetoanothervintage@gmail.com and describe the nature of your concern and the relief you seek. We will have 60 days from receipt of your notice to attempt to resolve the matter informally.
Binding Arbitration
If the dispute is not resolved informally, it shall be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted by a single arbitrator in Los Angeles, California, though hearings may be held via teleconference or videoconference. The arbitrator's decision shall be final and may be entered as a judgment in any court of competent jurisdiction.
Small Claims Court
Nothing in this section prevents you from pursuing a claim in small claims court on an individual basis, if your claim qualifies.
Class Action Waiver
BY AGREEING TO THESE TERMS, YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. ALL DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS ONLY.
Injunctive Relief
Either party may seek temporary injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.
Governing Law & Venue
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes not subject to arbitration shall be resolved exclusively in the state or federal courts located in Los Angeles, California.
Changes to These Terms
We may update these Terms at any time. Changes will be posted on our website with an updated effective date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. All provisions that by their nature should survive termination will do so, including limitation of liability, indemnification, and arbitration.
Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision shall not constitute a waiver. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service. You may not assign your rights under these Terms without our written consent.
